These Terms of Service (the "Terms") govern your access to and use of games, applications, websites, and related online services provided by Nikolai Bondarev, an individual entrepreneur ("we", "us", or "our"), collectively, the "Services".
By accessing or using a Service, or by creating an account, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
The Services are intended for a general audience and are not directed to children under 13. You must be at least 13 and meet any higher minimum age required in your country to use the Services.
If you are below the age at which you may enter into a binding agreement in your country, your parent or legal guardian must review and agree to these Terms on your behalf.
2. License and Use of the Services
Subject to these Terms and applicable platform rules, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services for their intended personal, non-commercial purposes.
The Services are licensed, not sold. No ownership rights are transferred to you.
3. Accounts
Some Services create or use an in-game account and may allow you to sign in through Google or another authentication provider.
You must provide accurate information, keep your sign-in credentials secure, and promptly notify us if you believe your account has been compromised. You are responsible for activity performed through your account to the extent permitted by applicable law.
You must not:
- impersonate another person;
- create an account for another person without authorization;
- access another user's account;
- bypass authentication or security mechanisms; or
- create or use an account for fraud or another unlawful purpose.
Third-party authentication services are also governed by their own terms and policies.
4. Acceptable Use
You must not:
- interfere with or disrupt the Services or related infrastructure;
- attempt to gain unauthorized access to systems, accounts, or data;
- distribute malware or other malicious code;
- discover, test, or exploit vulnerabilities without our prior written authorization;
- intentionally overload or degrade the Services;
- use bots, scripts, scrapers, or other automated systems in a way that disrupts the Services, provides an unfair advantage, or violates applicable law;
- cheat, manipulate game state, falsify results, or exploit bugs in multiplayer or competitive functionality;
- sell, rent, transfer, or commercially exploit an account or access to the Services;
- reverse engineer, decompile, disassemble, or attempt to derive source code from the Services, except to the extent that this restriction is prohibited by applicable law;
- remove or alter proprietary notices; or
- use the Services in violation of applicable law or third-party rights.
We may use reasonable technical and administrative measures to prevent abuse, enforce game rules, and protect the Services and their users.
5. Game Rules and Online Functionality
Certain Services may include multiplayer, competitive, cooperative, leaderboard, account synchronization, or other online functionality. You must follow rules displayed within the relevant Service.
We may update game mechanics, balancing, progression, matchmaking, rewards, events, and online systems. These changes may affect the availability or relative value of gameplay features, achievements, or virtual items, subject to applicable consumer law.
6. Advertising
The Services may display contextual or personalized advertising. Advertising availability and personalization may depend on your location, platform settings, age, and consent choices.
Advertising providers may collect or receive information as described in our Privacy Policy. We do not use account information obtained through Google Sign-In for advertising.
Third-party advertisements may link to products or services outside our control. We are not responsible for those products or services, but this does not exclude responsibility that cannot legally be excluded.
7. Purchases, Subscriptions, and Virtual Items
Some Services may offer virtual currency, virtual items, unlockable content, subscriptions, or other digital features (collectively, "Virtual Items"). The price and material terms of a purchase are shown before you confirm it.
Unless expressly stated otherwise and subject to applicable law:
- Virtual Items have no monetary value outside the relevant Service;
- Virtual Items cannot be exchanged for real-world currency;
- Virtual Items provide a limited license to use digital functionality within the Service; and
- Virtual Items are not transferable between users or Services.
Purchases are processed by the platform through which they are made and are subject to that platform's payment, cancellation, and refund rules. Any statutory rights you have remain unaffected.
If a Service offers an automatically renewing subscription, the price, billing period, renewal terms, and cancellation method will be displayed before purchase. You must cancel through the applicable platform before renewal to avoid the next charge. Deleting your account or uninstalling the Service does not automatically cancel a subscription.
If access to paid content is removed because we permanently discontinue a Service, any refund or remedy will be provided where required by applicable law or platform rules.
8. Intellectual Property
The software, graphics, audiovisual materials, text, logos, designs, and other content in the Services are owned by us or our licensors and are protected to the extent provided by applicable intellectual-property laws.
Except for the limited license granted by these Terms, no rights in the Services or their content are granted to you. Third-party software, libraries, assets, trademarks, and materials remain the property of their respective owners and may be subject to separate licenses.
9. User Content
Some Services may allow you to submit names, messages, feedback, images, or other content ("User Content"). You retain any ownership rights you have in your User Content and remain responsible for it.
You must not submit User Content that is unlawful, threatening, abusive, fraudulent, malicious, deceptive, sexually exploitative, invasive of privacy, or infringing of another person's rights.
You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, and otherwise process User Content only as reasonably necessary to operate, secure, moderate, and improve the relevant Service. This license ends when the User Content is deleted from our systems, except where continued retention is required by law or reasonably necessary for security, disputes, or backups awaiting deletion in the ordinary cycle.
We may remove or restrict User Content that violates these Terms or creates legal, safety, or security risks. Where required by law, we will provide an explanation or appeal mechanism.
10. Feedback
If you voluntarily provide suggestions, ideas, bug reports, or other feedback about the Services, you grant us permission to use that feedback to develop and improve our products without restriction or compensation. This does not transfer ownership of materials independently protected by your intellectual-property rights.
11. Third-Party Services
The Services may integrate with authentication providers, app stores, advertising and analytics services, multiplayer networks, social platforms, and cloud providers. Your use of a third-party service is also governed by that provider's terms and policies.
We are not responsible for third-party products or services outside our control. This provision does not limit rights or remedies that cannot legally be excluded.
12. Availability, Changes, and Updates
We may update, modify, suspend, or discontinue all or part of a Service. We do not guarantee that every feature, server, event, or online function will remain available indefinitely.
Interruptions may occur because of maintenance, updates, technical or network failures, third-party outages, security incidents, or circumstances outside our reasonable control. Where reasonably practical, we will try to minimize disruption.
Some Services require updates to remain secure or compatible with online functionality. Older versions may stop working or may no longer be supported.
13. Suspension and Termination
We may restrict, suspend, or terminate your access where reasonably necessary, including if you materially violate these Terms, cheat, engage in fraud or abuse, attack the Services, create a security risk, or violate applicable law.
Where appropriate and legally required, we will provide notice and a reasonable opportunity to remedy a violation or appeal a decision. Immediate action may be taken where necessary to prevent fraud, harm, security incidents, or disruption.
You may stop using the Services at any time. You may request deletion of your account through the account or privacy settings in the relevant Service or by following the instructions at Delete Account page.
Upon deletion or termination, your license to use the Services ends and you may lose access to game progress, online features, and Virtual Items associated with the account. Terms that by their nature should survive termination—including provisions concerning intellectual property, disclaimers, liability, disputes, and accrued obligations—remain in effect.
14. Privacy
Our handling of personal information is described in our Privacy Policy:
The Privacy Policy is a notice about data processing and does not make consent the legal basis for processing where another legal basis applies.
15. Disclaimers
The Services are provided on an "as is" and "as available" basis. To the extent permitted by applicable law, we do not guarantee that the Services will always be uninterrupted, error-free, secure, or compatible with every device or software configuration.
Nothing in these Terms excludes or limits a warranty, statutory guarantee, right, or remedy that cannot legally be excluded or limited under applicable consumer law.
16. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or similar damages, or for loss of data, profits, revenue, goodwill, or business opportunities, arising from or relating to the Services.
These limitations do not apply to liability arising from fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited.
Mandatory consumer rights and remedies remain unaffected.
17. Indemnification
To the extent permitted by applicable law, you are responsible for losses, liabilities, and reasonable costs arising from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person's rights.
This section does not apply to the extent the loss was caused by us and does not limit your rights under mandatory consumer law.
18. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Armenia, without regard to conflict-of-law principles.
Courts located in Yerevan, Republic of Armenia will have jurisdiction over disputes, except that a consumer may bring a claim in another court or rely on the mandatory law of their country where applicable consumer law permits or requires it.
Before filing a claim, you and we agree to make a reasonable effort to resolve the dispute informally by contacting the other party. This does not prevent either party from seeking urgent relief or using a statutory complaint or dispute-resolution procedure.
19. Changes to These Terms
We may update these Terms to reflect changes to the Services, law, platform requirements, security needs, or business practices. The revised Terms will state their effective date.
If a change materially and adversely affects your rights, we will provide reasonable advance notice where practical and obtain renewed agreement where required by law. Changes will not retroactively reduce rights relating to transactions already completed unless permitted by law.
If you do not agree to revised Terms, you must stop using the Services and may delete your account.
20. General
If a provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent. We may transfer these Terms as part of a reorganization, merger, acquisition, or transfer of the relevant business, subject to applicable law.
These Terms and any service-specific rules presented to you form the agreement between you and us regarding the Services. Mandatory platform terms and consumer rights continue to apply.
